Terms and Conditions

  1. The promoter is Hovis Limited, The Lord Rank Centre, Lincoln Road, High Wycombe, Buckinghamshire, HP12 3QS (“Promoter”).
  2. The Promoter is responsible for the publication and adjudication of the Promotion and Element London Ltd (“Prize Fulfillment Agency”) is responsible for the arrangement, provision and fulfillment of the Grand Prize.
  3. The Promotion will commence at 00:01 (UK time) on 29 May 2017. The closing date for receipt of Entries (as defined in clause 30) is 23:59 (UK time) on 24 September 2017 (“Closing Date”).
  4. The Promotion is open to residents of the United Kingdom and Republic of Ireland who are aged 18 or over (“Eligible Participant”). No purchase is necessary from Northern Ireland and the Republic of Ireland. Please see clause 29 below for details on how to enter if you are resident in Northern Ireland or the Republic of Ireland.
  5. Any Eligible Participant that takes part in the Promotion (an “Entrant”) will be deemed to have read and accepted these terms and conditions and will be bound by them.
  6. Internet access is required to enter the Promotion.
  7. Employees of the Promoter and their immediate family members, Hovis’ agents, or any person professionally associated with this activity (or members of their family or household) may not participate in the Promotion.

The Grand Prize – a trip to New York

  1. The grand prize shall be a 5 night trip to New York (USA) for 1 traveller who must be aged 21 or over, 2 travellers who must be aged 15 or under, and a fourth traveller can be of any age, subject to the conditions and exclusions listed herein, including:

8.1. return economy flights from a London airport selected by the Promoter to a New York Airport selected by the Promoter (“NY Airport”) (together the “Flights”);
8.2. return ground transport from/to NY Airport to/from the Hotel (as defined below);
8.3. 5 nights’ accommodation in one family room in Sohotel 3* Hotel, New York (“Hotel”);
8.4. a 2 hour guided tour of the American Museum of Natural History (“Museum Tour”);
8.5. a private screening of a ‘Mad Science’ show held at the Hotel (“Show”);
8.6. a make your own ice-cream experience at Cool Mess, New York (“Experience”);
8.7. £1,000 cash spending money (“Cash”);
8.8. travel insurance for the trip provided by Planet Earth Travel Insurance Services Limited subject to the Grand Prize Winner (as defined below) and Guests meeting the policy’s eligibility criteria and conditions specified at http://www.wearetravelinsurance.co.uk/docs/Policy-Wording-16-02.pdf (any additional fees payable as a result of any pre-existing medical conditions or the answers to the ‘Important questions relating to Health, Activities and the Acceptance of Your Insurance shall be the responsibility of the winner)

(together the “Grand Prize”).

  1. There will be one (1) winner of the Grand Prize (“Grand Prize Winner”).
  2. The following conditions and restrictions apply to the Grand Prize:

Dates of the trip

10.1. the Grand Prize cannot be taken during Christmas and New Year (23rd December 2017 – 2nd January 2018), Easter (30th March – 3rd April 2018) and Bank Holiday periods in the UK (1st May, 29th May, 28th August 2017, and 7th May, 28th May, 27th August, 2018) and USA (29th May, 4th July, 23rd November 2017 and 4th July 2018);
10.2. the Grand Prize must be booked, attended and returned from within 12 months from the Notification Email (as defined in clause 40);
10.3. subject to clause 1 and 10.2, the Grand Prize Winner must provide the Prize Fulfillment Agency with three preferred departure dates and 6 weeks prior to their earliest preferred departure date;
10.4. the Promoter and/or Prize Fulfillment Agency will then select the dates and timings of the trip (and each component of the trip) from the Grand Prize Winner’s preferred departure dates and will notify the Grand Prize Winner;
10.5. the Promoter accepts no liability for any claims, fines, penalties or damages arising out of the Grand Prize being taken during school term time;
10.6. if the Promoter is unable to facilitate the Grand Prize Winner’s preferred departure dates, the Promoter will provide the Grand Prize Winner with alternative departure dates which the Grand Prize Winner can choose from. If the Grand Prize Winner cannot attend during the proposed departure dates, the Grand Prize Winner may forfeit the Grand Prize and another winner may be drawn;

The Flights

10.7. the Promoter and/or Prize Fulfillment Agency will select the dates and times of the Flights;
10.8. all Flight dates and times are subject to availability and any changes made by the airline;
10.9. Flights will be travelling from and returning to a London Airport and arriving at and returning from a NY Airport, both selected by the Promoter and/or Prize Fulfillment Agency, unless the Promoter notifies the Grand Prize Winner otherwise;
10.10. the Grand Prize Winner and Guests must travel together on the same Flights;
10.11. the Grand Prize Winner and Guests can check-in one item of luggage each subject to the size, weight and other restrictions of the airline provider;
10.12. once the Flights have been booked, they are only valid for the dates and times shown and the Flights cannot be changed;
10.13. any name changes to the Flights will be provided at the discretion of the Flight provider and the Grand Prize Winner will be liable for any associated costs;
10.14. the Grand Prize Winner and Guests’ travel on and in relation to the Flights will be subject to the airline’s terms and conditions;

The Hotel

10.15. the Grand Prize Winner and Guests’ stay at the Hotel will be subject to the Hotel’s terms and conditions;
10.16. the Grand Prize Winner and the Guests must share one family room;
10.17. the Grand Prize Winner or a Guest will be required to provide a current and valid credit card with sufficient funds available in order to check in at the Hotel for security deposit purposes;
10.18. the Grand Prize Winner and the Guests will be responsible for all incidentals incurred at the Hotel (e.g. room service, mini bar, breakfast, dinner etc.);
10.19. if the Hotel is unavailable during the travel dates, an equivalent or superior hotel will be offered at the Promoter’s/ Prize Fulfillment Agency’s election;

Other

10.20. the Cash will be paid in Pounds Sterling by BACS transfer to the Grand Prize Winner up to 10 days before the agreed departure date;
10.21. in order to receive the Cash, the Grand Prize Winner must provide their own personal bank details to the Prize Fulfillment Agency;
10.22. it is the responsibility of the Grand Prize Winner and Guests to meet any additional costs including relating to obtaining any travel insurance cover that is not covered by the travel insurance provided as set out in clause 8;
10.23. the Show will be conducted in the Hotel;
10.24. the Experience is only available Monday to Wednesday and the Promoter/Prize Fulfillment Agency will select the date and time of the Experience and notify the Grand Prize Winner during the trip;
10.25. the Museum Tour and Experience may be attended by members of the public;
10.26. the Grand Prize Winner and/or Guests will be responsible for their own travel arrangements to and from the Museum Tour, Show and Experience;
10.27. the Museum Tour, Show and Experience will be provided by third parties and in the event of cancellation by a provider, the Promoter will endeavor to provide an alternative activity where practicable;
10.28. the Grand Prize Winner and Guests must travel together on the transfers provided to and from NY Airport to the Hotel;
10.29. the Grand Prize does not include transport to or from the Grand Prize Winner’s home address to the airport;
10.30. the Grand Prize Winner or one Guest must be aged 21 or over in order to claim this Grand Prize;
10.31. Guests below the age of 16 must provide written parental consent to travel unless accompanied by their parent/legal guardian;
10.32. if the trip is cancelled by the Grand Prize Winner, no alternative tickets will be issued nor will any compensation, refund or substitute prize be provided;
10.33. the Grand Prize Winner and Guests will be responsible for arranging and paying for their ESTA USA visas;
10.34. unless stated otherwise, the Grand Prize does not include car parking charges, visa costs, souvenirs, gratuity charges, excursion/attraction costs, food and drink, spending money or any other costs that are not explicitly set out in these terms and conditions and neither the Promoter nor any provider of any part of the Grand Prize will be responsible for any such costs;
10.35. all elements of the Grand Prize must be taken together as part of the same trip and the Grand Prize Winner and Guests must all follow the same itinerary provided by the Prize Fulfillment Agency.

  1. The Grand Prize Winner and Guests must have and maintain valid passports with expiry dates no less than 6 months from the agreed departure date or such other duration as may be required by any relevant regulation. The Grand Prize Winner and Guests must not be subject to any restrictions on their rights to travel to and from the United States of America. Passport control and in-country authorities may reserve the right to refuse entry to the Grand Prize Winner and/or Guest. The Promoter and the Prize Fulfillment Agency shall not be responsible for ensuring the Grand Prize Winner’s ability to travel nor for any additional costs incurred should entry be refused.
  2. The Grand Prize Winner is responsible for their behaviour and the behaviour of their Guests whilst taking the Grand Prize. The Promoter and the Prize Fulfillment Agency reserves the right in its absolute discretion to exclude the Grand Prize Winner and/or Guest(s) from participation in the Grand Prize if the Grand Prize Winner and/or Guests act in a manner that is dangerous to themselves or to the public or is anti-social in any manner or which causes a disturbance or nuisance to others.
  3. It is the responsibility of the Grand Prize Winner and Guests to check any travel advisories issued by the Government and to determine whether they wish to accept the risk of travelling to the United States of America. The Promoter and the Prize Fulfillment Agency will not be responsible for any loss or damage suffered by the Grand Prize Winner or Guests arising out of their failure to follow any travel advisories issued by the Government. The Grand Prize Winner and Guests are responsible for obtaining any recommended inoculation and complying with any health regulations.
  4. The Promoter and the Prize Fulfillment Agency will not be liable or responsible for any loss or damage suffered by the Grand Prize Winner or Guests should they not redeem the Grand Prize as a result of any Government travel warning or advisory or for any other failure on their part to travel. In particular, the Promoter shall have no obligation to substitute any alternative prize, cash equivalent or other compensation where the Grand Prize Winner and/or Guests fail to redeem the Grand Prize for any reason.
  5. The Grand Prize Winner and Guests must comply with the terms and limitations of airlines, hotels, other transport providers, and the venues involved in the provision of the Grand Prize. In particular, they must comply with all health and safety guidelines and instructions and all applicable legal and regulatory requirements and local laws.
  6. The Grand Prize Winner and the Guests are required to comply with all instructions and requirements as may be specified by the Promoter, the Prize Fulfilment Agency or any authorised third party to take up the Grand Prize, including but not limited to providing responses within specified time frames, adhering to the itinerary, completing and delivering any required documents. The Promoter and Studio will not be liable to the Grand Prize Winner or Guests where they fail to comply with such instructions and such failure may result in the forfeiture of the Grand Prize (or a component thereof).
  7. The Grand Prize Winner and the Guests may be required to provide proof of address, proof of identity and/or their signature as proof of their agreement to relevant waivers, releases and/or consents when taking up the Grand Prize. Failure to provide or sign any such document may result in forfeiture of the Grand Prize (or a component thereof).
  8. Save as stated otherwise in these terms, in the event that the Grand Prize Winner (or a Guest) forfeits any component of the Grand Prize, for example, the Experience, an alternative will not be provided.
  9. The Prize Fulfillment Agency will correspond with the Grand Prize Winner in order to arrange the fulfillment of the Grand Prize.

The Prizes

  1. The Grand Prize and DM3 Prizes (as defined in clause 1 of the Additional Terms) shall together be referred to as the “Prizes”.
  2. The Prizes (and each component of the Prizes) are non–transferable and non-exchangeable and there is no cash alternative.
  3. The Promoter reserves the right to substitute any Prize or any component of a Prize of equal or greater value at anytime.
  4. The Promoter excludes all liability for taxes and other costs or liabilities arising from the Promotion or the Prizes and any such costs will be the sole responsibility of the recipient of Prize Winners.
  5. Prizes or promotional products must not be auctioned or resold. The Promoter reserves the right to refuse to accept further Entries from any Entrant, and/or to disqualify any Entries from that Entrant from any subsequent draw, under the Promotion if it becomes aware of the reselling or auctioning of Prizes or promotional items by or on behalf of that Entrant.

How to enter

  1. All Entries (as defined in clause 30) will be entered into a prize draw for a chance to win:

25.1. the Grand Prize; and
25.2. a DM3 Prize (as defined in clause 1 of the Additional Terms).

For UK mainland Entrants (England, Scotland and Wales)

  1. The Promotion is available on the promotional packs of Hovis® Soft White (800g) medium and thick bread and Hovis® Best of Both® (750g) medium and thick bread (“Promotional Products”).
  2. The Promotional Products are available in selected branches of Asda, Tesco, Sainsbury’s, Morrisons and Waitrose and other independent stores throughout the United Kingdom and are subject to availability while stocks last.
  3. To enter the Promotion, before the Closing Date the Eligible Participants from the UK mainland must:

28.1. locate the 10 digit code (comprising letters and numbers) on the best before tag on a Promotional Product (“Code”);

28.2. visit www.HovisDespicableMe3.com;
28.3. enter their postcode and click “Enter Here”;
28.4. enter the Code when prompted and click “Next”;
28.5. acknowledge their acceptance of these terms and conditions and the Promoter’s privacy policy and click “Next”;
28.6. enter their full legal name, date of birth, email address, telephone number and full address of permanent residence; and
28.7. click “Submit Entry”.

For Northern Ireland and Republic of Ireland Entrants

  1. To enter the Promotion, before the Closing Date Eligible Participants from Northern Ireland and Republic of Ireland must:

29.1. visit www.HovisDespicableMe3.com;
29.2. enter their postcode and click “Enter Here”;
29.3. acknowledge their acceptance of these terms and conditions and the Promoter’s privacy policy and click “Next”;
29.4. enter their full legal name, date of birth, email address, telephone number and full address of permanent residence; and
29.5. click “Submit Entry”.

  1. The execution of the processes by an Entrant specified under clause 28 and 29 shall each be referred to as an “Entry” and together the “Entries”.
  2. The Promotional Products will be available in Northern Ireland. Republic of Ireland and possibly other territories, however, only residents of the UK, excluding Northern Ireland, are required to obtain the Code from a Promotional Product to enter the Promotion.
  3. Only one Entry can be made by an Eligible Participant within a 7 day period. Additional Entries made by the same Eligible Participant within a 7 day period will not be accepted.
  4. Entrants must enter the Promotion using their legal name. The Promoter may require Entrants to verify their legal name and address. The Promoter will require such information as it considers reasonably necessary for this purpose and the Prize may be withheld unless and until the Promoter is satisfied with the verification.
  5. An Entry must contain the requisite information specified in clause 28 or 29 (as applicable) and be in legible English. Any Entry that does not contain the information required above will be an invalid entry and will not be entered into the Promotion.
  6. Once an Entrant has submitted their Entry, the Promoter will send an email to the email address provided within the Entry to confirm the Entry has been received.
  7. The Promoter cannot accept responsibility for lost, incomplete, delayed or illegible Entries or for network, computer, hardware or software failures of any kind which may restrict or delay the sending or receipt of Entries.
  8. The Promoter will not accept entries by any other method, including but not limited to telephone, fax, email, or a social networking site.
  9. Entrants may not change any information in their Entry after submission of their Entry. It is the Entrant’s responsibility to ensure that they can be contacted through the information included in their Entry throughout the Promotion. The Promoter is unable to accept any information concerning changes of address or other contact information.

Grand Prize Winner Selection, Notification and fulfillment of the Grand Prize

  1. Within 14 days of the Closing Date all Entries will be entered into a prize draw and the Grand Prize Winner will be selected at random from all validly submitted Entries, by an independent adjudicator.
  2. The Grand Prize Winner will be notified within 14 days of their selection by email, to the email address provided within their Entry (“Notification Email”).
  3. To claim the Grand Prize, the Grand Prize Winner must reply to the Notification Email, confirming their acceptance of the Grand Prize and their preferred contact number, within 14 days of the Notification Email.
  4. The Prize Fulfillment Agency will correspond with the Grand Prize Winner in order to arrange the fulfillment of the Grand Prize.
  5. The Grand Prize Winner is responsible for making themselves available in order to arrange the fulfilment of the Grand Prize with the Prize Fulfilment Agency and for providing the requisite information within the time periods specified by the Prize Fulfilment Agency. If the Grand Prize Winner cannot be contacted or successful contact is not made within 14 days of the Notification Email or within any other time frame specified by the Promoter or the Prize Fulfilment Agency, this may result in the forfeiture of the Grand Prize and the Promoter reserves the right to disqualify the Prize Winner and offer the Grand Prize to another Entrant drawn at random.

General

  1. The Grand Prize Winner and DM3 Magnet Set Winners (as defined in clause 2 of the Additional Terms) will together be referred to as the “Prize Winners”.
  2. The Promoter does not claim any rights of ownership in an Entry, nor does the Promoter accept responsibility for the return of any Entry, including those consisting of artistic or other material.
  3. In all matters relating to the Promotion, the decision of the Promoter shall be final and no correspondence or discussion shall be entered into.
  4. At all times throughout the Promotion, the Entrants, Prize Winners and Guests must deal with the Promoter and any other parties assisting in the administration or fulfillment of the Promotion in the utmost good faith in every respect. The Promoter reserves the right to verify the eligibility of all Entrants and disqualify any Entrant that it has reasonable grounds to believe has breached any of the terms and conditions, including, but not limited to, falsifying any information submitted to or requested by the Promoter.
  5. The Promoter reserves the right to amend or terminate the Promotion at any time without notice. Any termination or amendments to the Promotion will be notified to you at www.HovisDespicableMe3.com.
  6. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and prevents the Promoter from complying with these terms and conditions, such as a change to a venue or an alteration or cancellation of an event, the Promoter will not be liable for any failure to perform or delay in performing its obligation.
  7. The Promoter, through its Prize Fulfilment Agency, is responsible for making available the Prizes as specified in these terms and conditions. The Prize Winner and/or Guest’s use of a Prize is subject to all applicable terms and conditions specified by the relevant providers (including travel, accommodation and experience providers). The Promoter is not responsible for a Winner and/or Guest’s failure to comply with such applicable terms and conditions.
  8. The Prize Winners and Guests (where applicable) may be requested to take part in promotional activity and the Promoter reserves the right to use the names and addresses of the Prize Winner, their photographs and audio and/or visual recordings of them in any publicity, including but not limited to on social media, the Promoter’s websites, advertisements, press releases and alike.
  9. By entering the Promotion, Entrants consent to the use of their personal data which they submit by participating in the Promotion, by the Promoter, the Promoter’s website administrator and their service providers, suppliers and agents, for the purpose of administering the Promotion and fulfilling a Prize and for any other purposes that the Entrant consents to. Data relating to Entrants will be retained by the Promoter for a reasonable period after the Promotion closes to assist the Promoter to operate promotions in a consistent manner and to deal with any queries in relation to the Promotion. Further details of how your information may be used are set out in the Promoter’s Privacy Policy at http://www.hovis.co.uk/other-pages/privacy-policy.
  10. By accepting a Prize, the Prize Winner and the Guests consent to the use of their personal data which they provide for the fulfillment of a Prize, by the Promoter, Studio, Prize Fulfillment Agency, Promoter’s agents, website administrators and suppliers, and any other third party that requires a Prize Winner and Guests’ personal data for the fulfillment of a Prize.
  11. By taking part in the Promotion, the Prize Winners agree that the Promoter (or any third party nominated by the Promoter) may in its sole discretion use the Prize Winners’ names, locations and comments relating to the Prize for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid.
  12. The Promotion is run by the Promoter with the permission of Universal Studios. Unless stated otherwise, the Promotion is not sponsored or endorsed by, or otherwise connected with, any prize provider. The Promotion does not constitute an endorsement or recommendation of the products or services being offered as part of a Prize.
  13. The name and county of a Prize Winner is available by sending a letter including a self addressed, stamped envelope to Hovis Marketing Team, Despicable Me 3 Promotion, The Lord Rank Centre, Lincoln Road, High Wycombe, Buckinghamshire, HP12 3QS, after 22 October 2017, for 4 weeks.

  15. The Promotion and any issues, disputes or claims arising out of or in connection with it (whether contractual or non-contractual) shall be governed by, and construed in accordance with, the laws of England and Wales. Entrants agree that the Courts of England and Wales shall have non-exclusive exclusive jurisdiction to settle any disputes or claims arising out of or in connection with it (whether contractual or non-contractual). Entrants from Scotland, Northern Ireland or the Republic of Ireland shall be entitled to bring claims in relation to the Promotion in their home courts.

Despicable Me 3 merchandise daily draw (“Additional Terms”)

  1. The following terms and conditions apply to the Despicable Me 3 magnet set daily prize draw, in addition to the terms set out above.
  2. The Despicable Me 3 prize shall be a set of three Despicable Me 3 magnets (each a “DM3 Prize” and together a “DM3 Prizes”). The DM3 Prizes are not suitable for children under the age of 3 due to small parts and are not for resale.
  3. There will be 10,000 DM3 Prizes available to win (each a “DM3 Winner” and together the “DM3 Winners”).
  4. Every day there will be a prize draw from all valid Entries made the day before. For example, all Entries made on 1 June 2017 will be entered into a draw on 2 June 2017 and all Entries made on 2 June 2017 will be entered into a draw on 3 June 2017.
  5. The DM3 Winners will be selected at random from all validly submitted entries, via a secure independently verified computer system, in each daily draw.
  6. There will be a minimum of 84 DM3 Prizes awarded per day subject to the Promoter receiving at least 84 valid Entries the previous day. If any DM3 Prizes are not allocated on a particular day due to less valid Entries being received the previous day, these DM3 Prizes will be rolled over and distributed over the remainder of the Promotion.
  7. Within 2 days of their selection, the DM3 Winners will receive an email to inform them if they have won a DM3 Prize and that a DM3 Prize shall be posted to the address provided in the DM3 Prize Winner’s Entry (“Notification”).
  8. Within 7 days of the Notification, the Promoter will post the DM3 Prize to the address provided in the DM3 Prize Winner’s Entry.
